Terms of Use & Disclaimers

Effective date: September 22, 2026 · Last updated: September 22, 2026

These Terms of Use and Disclaimers ("Terms") govern your access to and use of rottetwellness.com and any related pages, forms, scheduling tools, and communications operated by Rottet Wellness (the "Website"). Rottet Wellness is the chiropractic and clinical nutrition practice of Thomas Rottet, D.C., CFMP, a chiropractor licensed by the Commonwealth of Pennsylvania, with offices at 1120 Centre Turnpike, Orwigsburg, Pennsylvania 17961 ("Rottet Wellness," "we," "us," or "our").

Please read these Terms carefully. By accessing the Website, submitting a form, booking a consultation, or otherwise communicating with us through the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Website.

If This Is an Emergency, Stop Reading

If you are experiencing a medical emergency — including chest pain, difficulty breathing, sudden weakness or numbness, loss of consciousness, severe injury, or thoughts of harming yourself — call 911 or go to the nearest emergency department immediately. Do not use this Website, our contact form, email, or social media to seek emergency care. We do not monitor these channels continuously and cannot respond to urgent medical needs.

01Medical Disclaimer — Educational Content Only

All content on the Website — including articles, blog posts, service descriptions, videos, infographics, downloadable material, and social media posts — is provided for general educational and informational purposes only. It is not medical advice, and it is not a substitute for individualized diagnosis, examination, or treatment by a qualified healthcare provider who knows your history.

Health information is general by nature. What is appropriate for one person may be inappropriate, ineffective, or harmful for another. Nothing on the Website is intended to diagnose, treat, cure, or prevent any disease or condition in any individual reader.

Always seek the advice of your physician, chiropractor, or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice, or delay seeking it, because of something you have read on this Website.

02No Doctor–Patient Relationship Is Created by This Website

Reading the Website, subscribing to updates, submitting a contact form, or requesting a complimentary consultation does not create a doctor–patient, chiropractor–patient, or other professional relationship between you and Dr. Rottet or Rottet Wellness.

A professional relationship is established only after you have (a) attended an appointment in person or by telehealth, (b) completed our intake and health history documentation, and (c) signed our written informed consent to care. Until all three have occurred, no clinical relationship exists and no duty of care arises.

Information you send us before a professional relationship is established is not protected by that relationship and may not be treated as confidential patient information. Please do not send detailed personal health information through the Website contact form, email, or social media.

03Scope of Practice and Professional Licensure

Dr. Thomas Rottet is licensed in the Commonwealth of Pennsylvania as a Doctor of Chiropractic (D.C.) and is regulated by the Pennsylvania State Board of Chiropractic. He received his Doctor of Chiropractic degree from Palmer College of Chiropractic in 1995.

Under the Pennsylvania Chiropractic Practice Act, chiropractic is defined at 63 P.S. § 625.102 and expressly does not include the practice of obstetrics or gynecology, the reduction of fractures or major dislocations, or the use of drugs or surgery. Dr. Rottet does not prescribe, dispense, adjust, or discontinue prescription medication, and does not perform surgery. Any diagnosis performed is that permitted by statute — diagnosis necessary to determine the nature and appropriateness of chiropractic treatment.

Nutritional counseling is within the statutory definition of chiropractic in Pennsylvania. The statute also provides that licensure as a chiropractor is not required in order to engage in nutritional counseling.

Regarding functional medicine: "Certified Functional Medicine Practitioner" (CFMP) is a professional certification, not a state license, and the Commonwealth of Pennsylvania does not license or regulate "functional medicine" as a distinct profession. Functional medicine services offered by Rottet Wellness are provided as chiropractic care, nutritional counseling, and health and wellness education within the scope described above. They are not the practice of medicine, and they are not a replacement for care from your primary care physician or any specialist treating you.

04Do Not Stop or Change Prescribed Medication

Nothing on this Website, and nothing said in a consultation with Dr. Rottet, should be understood as advice to stop, reduce, delay, or alter any medication, treatment, or procedure prescribed or recommended by your physician or another licensed provider.

Decisions about prescription medication belong to you and your prescribing physician. We work alongside your existing care, not around it.

A Genuine Safety Point

Significant changes to diet, fasting, weight, or exercise can affect how certain medications act in your body — glucose-lowering medications such as insulin or metformin, blood pressure medications, and anticoagulants among them. If you take any of these, coordinate dietary or lifestyle changes with your prescribing physician so your medication can be monitored and adjusted by the person responsible for it.

05Individual Results Vary — No Guarantee of Outcome

Health outcomes depend on factors we do not control, including your diagnosis, genetics, age, adherence to a care plan, other conditions and medications, and circumstances outside a clinical setting.

We make no promise, guarantee, or warranty of any particular health result. Any outcome described on the Website — in an article, a case description, a testimonial, or a statistic drawn from published research — reflects that individual or that study population and should not be understood as a prediction of what you will experience. Published research describes averages across groups; it does not establish what will happen for any one person.

Statistics and study findings cited on the Website are summarized in plain language from the sources linked alongside them. We encourage you to read the underlying sources, which include their own limitations.

06Testimonials, Reviews, and Endorsements

Any testimonial, review, or patient comment published on the Website reflects the honest experience and opinion of that individual at the time it was given. Testimonials are not representative of every patient's experience, are not a guarantee of results, and are not a substitute for clinical evidence.

We do not pay for testimonials. Where any material connection exists between Rottet Wellness and a person providing an endorsement, we disclose it, consistent with the Federal Trade Commission's Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 C.F.R. Part 255).

07Dietary Supplements and Nutritional Products

Where Rottet Wellness recommends or provides professional-grade dietary supplements, the following applies:

  • These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.
  • Dietary supplements are regulated as foods, not as drugs, under the Dietary Supplement Health and Education Act. They are not reviewed for safety or efficacy by the FDA before they reach the market.
  • Supplements can interact with prescription medications and with each other, and are not appropriate for everyone. Tell your physician and pharmacist about every supplement you take.
  • Do not take supplements in place of a treatment your physician has prescribed.
  • If you are pregnant or nursing, have a diagnosed medical condition, or are scheduled for surgery, consult your physician before beginning any supplement.

Product descriptions, ingredient information, and labeling supplied by manufacturers are their representations, not ours, and we do not independently verify every manufacturer claim.

08Laboratory Testing

Rottet Wellness may recommend laboratory testing, including comprehensive blood chemistry and, where clinically appropriate, other panels. Please understand the following:

  • Laboratory tests are performed by independent, third-party laboratories that are solely responsible for the accuracy of their analyses and for their own licensure and certification.
  • Some tests used in functional medicine are interpreted against "functional" or "optimal" reference ranges that differ from conventional laboratory reference ranges. Functional ranges reflect clinical practice within functional medicine. They are not diagnostic criteria, are not universally accepted within conventional medicine, and a result outside a functional range is not a diagnosis of disease.
  • No laboratory test detects every condition, and no test result should be interpreted on its own or apart from your clinical history.
  • Laboratory testing arranged through our office may not be covered by your health plan. See Section 13.

09Telehealth Consultations

Rottet Wellness offers consultations by video, including a complimentary introductory consultation. By scheduling or attending a telehealth appointment, you acknowledge:

  • Geographic limitation. Telehealth services are available only to individuals physically located in the Commonwealth of Pennsylvania at the time of the appointment, unless we have separately confirmed in writing that we may lawfully serve you in your location. Professional licensure is generally determined by where the patient is located at the time of service, not by where the practitioner is located. If you are outside Pennsylvania, tell us before your appointment.
  • A complimentary introductory consultation is not a clinical visit. Its purpose is to discuss your goals and determine whether our approach is an appropriate fit. It is not an examination, does not produce a diagnosis or treatment plan, and does not create a doctor–patient relationship as described in Section 2.
  • Limits of the format. A video consultation does not permit physical examination or hands-on assessment. Some conditions cannot be evaluated adequately by video, and we may determine that an in-person visit or a referral is necessary.
  • Standard of care. Under Pennsylvania law, services delivered by telemedicine are subject to the same standard of care that applies in person.
  • Technology. Video consultations depend on third-party platforms and on your internet connection. Connections can fail, degrade, or be interrupted. Although we use reasonable measures to protect your privacy, no electronic transmission can be guaranteed secure, and we are not responsible for failures of third-party platforms or for interception outside our control.
  • Recording. We do not record consultations without your express permission, and we ask that you not record without ours. Pennsylvania is an all-party consent jurisdiction for the recording of communications.

10Appointments, Cancellations, and Missed Visits

Appointment times are reserved specifically for you. Rottet Wellness keeps a deliberately small practice, and a missed appointment is time that could have been given to another patient.

  • Please provide at least 24 hours' notice to cancel or reschedule.
  • Late cancellations and missed appointments may be subject to a fee, which will be disclosed to you in advance in our written practice policies. Fees for missed appointments are generally not reimbursable by insurance and are your responsibility.
  • We may reschedule or reassign an appointment where illness, emergency, or circumstances beyond our control require it.
  • Arriving late may shorten your appointment so that patients scheduled after you are not delayed.

The current, controlling cancellation and fee policy is the one provided to you in writing at the start of care. Where that written policy differs from this Section, the written policy governs for clinical services.

11Fees and Payment

Fees for routine professional services are available on request and will be disclosed to you before care begins. Payment is due at the time services are rendered unless we have agreed otherwise in writing.

We accept payment by the methods identified at our office. We accept funds from Health Savings Accounts (HSA) and Flexible Spending Accounts (FSA); whether a particular service is an eligible expense under your account is determined by your plan administrator and by federal tax rules, not by us.

12Out-of-Network Status and Insurance

Rottet Wellness is an out-of-network provider. We are not contracted with health insurance plans and do not bill insurance on your behalf.

  • We provide a detailed superbill on request so that you may seek out-of-network reimbursement directly from your plan.
  • We do not guarantee that your plan will reimburse any amount. Coverage, deductibles, allowed amounts, and out-of-network benefits are determined solely by your insurer under your plan documents.
  • Providing a superbill is an administrative courtesy. It is not a representation that a service is covered, medically necessary as your plan defines that term, or reimbursable.
  • You are responsible for the full cost of services regardless of whether your insurer reimburses you.
  • We encourage you to contact your insurer before beginning care to understand your out-of-network benefits.

13Privacy, Confidentiality, and Communications

Protected health information created or maintained in the course of providing care is handled in accordance with applicable law, including the Health Insurance Portability and Accountability Act (HIPAA) and its implementing regulations at 45 C.F.R. Parts 160 and 164, and is described in our Notice of Privacy Practices, which is provided separately at the start of care.

Our separate Privacy Policy describes how the Website itself collects and uses information such as form submissions, analytics data, and cookies.

Please note the following about communications:

  • Ordinary email, website forms, text messages, and social media are not secure and are not appropriate for protected health information. Information you send through these channels may be intercepted or accessed by others.
  • Do not use email, forms, or social media for urgent clinical matters. See the emergency notice above.
  • If you provide a telephone number and consent to receive text messages, message and data rates may apply, message frequency varies, and you may opt out at any time by replying STOP. Consent to receive marketing messages is never a condition of receiving care.
  • In the event of a breach of personal information as defined by Pennsylvania's Breach of Personal Information Notification Act, 73 P.S. § 2301 et seq., and by applicable federal law, we will provide notice as those laws require.

14Website Content, Intellectual Property, and Permitted Use

All content on the Website — text, articles, photographs, graphics, logos, page design, and the compilation and arrangement of all of it — is owned by Rottet Wellness or its licensors and is protected by United States copyright, trademark, and other intellectual property laws. "Rottet Wellness" and our logo are our marks.

You may view, download, and print Website content for your own personal, non-commercial use, provided you do not remove any copyright or proprietary notice. Any other use — including reproduction, republication, distribution, public display, framing, or the creation of derivative works — requires our prior written permission.

You agree not to:

  • use the Website for any unlawful purpose, or in violation of these Terms;
  • attempt to gain unauthorized access to the Website, its servers, or any related system or data;
  • introduce malware, or interfere with or disrupt the operation, security, or integrity of the Website;
  • use automated means — scrapers, bots, crawlers — to harvest content or personal information from the Website, or to use Website content to train machine learning or artificial intelligence systems, without our prior written permission;
  • impersonate any person, or misrepresent your affiliation with any person or entity;
  • submit content that is false, defamatory, harassing, infringing, or that discloses another person's health information without their authorization.

We may suspend or terminate access to the Website, remove content, or take other action for any violation of this Section.

The Website links to and cites third-party resources — peer-reviewed research, government health agencies, professional organizations, and similar sources. These citations support the educational content and do not imply that any third party endorses Rottet Wellness, or that we endorse every statement or position of that third party.

We also rely on third-party services for scheduling, video consultations, payment processing, analytics, and social media. Your use of those services is governed by the third party's own terms and privacy policies, which we encourage you to read.

We do not control third-party websites or services and are not responsible for their content, accuracy, availability, security, or privacy practices. Links are provided for convenience only.

16Accessibility

We want the Website to be usable by everyone, and we work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. Accessibility is ongoing rather than finished, and some content — particularly third-party embeds — may not yet fully conform.

If you encounter a barrier, or need information from the Website in an alternative format, please contact us at (570) 366-2613 and we will work to provide the information you need. If you require an accommodation to access our services, tell us when you schedule so that we can arrange it.

17Age Requirement and Minors

The Website is intended for adults. You must be at least 18 years old to submit a form, schedule an appointment, or otherwise transact through the Website. We do not knowingly collect personal information online from children under 13, consistent with the Children's Online Privacy Protection Act.

Minors may receive care at Rottet Wellness only with the consent of a parent or legal guardian, who must be present for the initial visit and who is responsible for scheduling and payment.

18Disclaimer of Warranties

The Website and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, or accuracy.

Without limiting the foregoing, we do not warrant that the Website will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that the Website is free of viruses or other harmful components; or that content will remain current. Health science changes, and content accurate when published may become outdated. We have no obligation to update any content.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

19Limitation of Liability

To the fullest extent permitted by Pennsylvania law, Rottet Wellness and Dr. Thomas Rottet will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of the Website or reliance on its content, whether based in contract, tort, strict liability, or any other theory, and even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Website will not exceed one hundred dollars ($100.00).

What This Section Does Not Do

This Section limits liability arising from the Website and its educational content. It does not limit, waive, or release any liability arising from professional services actually rendered to a patient. Nothing in these Terms waives any right you may have with respect to professional negligence, personal injury, or death, and no provision of these Terms should be read as attempting to do so. Pennsylvania law does not permit a provider to disclaim liability for professional negligence by means of a website notice, and we do not attempt to.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you in full.

20Indemnification

You agree to indemnify and hold harmless Rottet Wellness, Dr. Thomas Rottet, and our employees and contractors from any claim, demand, loss, liability, or expense, including reasonable attorneys' fees, arising out of your misuse of the Website, your violation of these Terms, your violation of any law, or your infringement of the rights of any third party. This Section does not apply to claims arising from professional services rendered to you.

21Changes to These Terms and to the Website

We may revise these Terms at any time. The revised version takes effect when posted, and the "Last updated" date at the top of this page will change. Your continued use of the Website after a revision constitutes acceptance of the revised Terms. Please review this page periodically.

We may also modify, suspend, or discontinue any part of the Website at any time, without notice and without liability.

22Governing Law, Venue, and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules.

Informal resolution first. If you have a concern, please contact us directly at (570) 366-2613. Most matters are resolved in a single conversation, and we would rather hear from you than not. You agree to contact us and allow thirty (30) days to resolve a dispute informally before initiating formal proceedings.

Venue. Any action arising out of or relating to these Terms or the Website that is not resolved informally shall be brought exclusively in the state courts located in Schuylkill County, Pennsylvania, or in the United States District Court for the Middle District of Pennsylvania, and you consent to the personal jurisdiction of those courts. This provision applies to disputes concerning the Website and does not alter any right or forum otherwise available to you by law in a matter concerning professional services.

Nothing in these Terms prevents you from filing a complaint with a regulatory authority. See Section 24.

23General Provisions

Severability. If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign these Terms. We may assign them in connection with a transfer of the practice.

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rottet Wellness regarding the Website. Where a written clinical agreement, informed consent, financial policy, or Notice of Privacy Practices addresses the same subject with respect to patient care, that document governs for the care relationship.

Headings. Section headings are for convenience and do not affect interpretation.
